Welcome to the Kempton Community Center ("KCC," "we," "us," or "our"). By accessing or using our website (https://www.kemptoncommunitycenter.org/), purchasing a membership, booking a facility rental, making a donation, or participating in our events, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use our website or services.
1. About the Kempton Community Center
The Kempton Community Center is a non-profit community organization serving Albany Township and surrounding neighbors since 1961. We are funded solely by fundraising events, memberships, and volunteer contributions. We do not receive funding from governmental entities.
2. Memberships
Term: Annual memberships run from January 1st to December 31st of the calendar year. Memberships expire on December 31st unless purchased in October or later of the prior year.
Fees & Communications: Membership fees are subject to change. By becoming a member, you agree to provide accurate information and consent to receiving communications from KCC regarding events, board meetings, and newsletters. 3. Facility Rentals
Our website allows users to inquire about facility and indoor court rentals. Separate Agreements: Any facility rental is subject to a separate, formal Rental Agreement. In the event of a conflict between these website Terms and your specific Rental Agreement, the terms of the Rental Agreement will prevail. 4. Donations and Purchases
Donations: All donations made through our website are voluntary and non-refundable. We greatly appreciate your support. Apparel Sales: We may offer KCC apparel or merchandise for sale. All sales are final unless otherwise stated. We reserve the right to limit quantities or discontinue products at any time. Prices are subject to change without notice.
5. Community Events & The Kempton Fair
KCC hosts various community events, including the Kempton Fair. Participation in these events is at your own risk. We reserve the right to modify, postpone, or cancel events due to weather, safety concerns, or other unforeseen circumstances. Attendees must comply with all posted rules, safety guidelines, and instructions from KCC staff and volunteers.
6. Photography and Media Release
By attending events, using our facilities, or participating in Kempton Community Center programs (including the Kempton Fair), you consent to be photographed, filmed, and/or otherwise recorded by KCC staff, volunteers, or authorized photographers.
You grant the Kempton Community Center the irrevocable right and permission to use, publish, reproduce, and distribute these photographs and video recordings (no audio) for any lawful purpose. This includes, but is not limited to, use on our website, social media pages, newsletters, advertising, and other promotional materials, without compensation, prior notice, or further approval. If you do not wish to be photographed or recorded, please notify the photographer, event organizer, or KCC staff member on-site. We will make reasonable efforts to accommodate your request, though we cannot guarantee you will not be captured in background shots of large public events.
7. Website Use and Intellectual Property
Content: All content on this website, including logos (such as the KCC Logo), text, graphics, newsletters, and images, is the property of the Kempton Community Center and is protected by copyright and intellectual property laws. Restrictions: You may not reproduce, distribute, or use our content for commercial purposes without our express written permission.
8. Limitation of Liability
To the maximum extent permitted by applicable law, the Kempton Community Center, its Board of Directors, volunteers, and representatives shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:
Your use of or inability to use the website. Your attendance at KCC events or use of KCC facilities (unless strictly outlined in a separate written agreement). Errors, inaccuracies, or omissions in website content.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any legal action or proceeding related to our website or services shall be brought exclusively in the state or federal courts located in or near Berks County, Pennsylvania.
